NOTICE OF HEARING EXAMINER OPEN RECORD PUBLIC HEARING

File No. 912.61.15-03 – “Orchard View Estates, Phases 2 through 5” Dainard Paulson Notice of Application and Environmental Review,

Application: On December 11, 2015 the City of Selah Planning Department received a preliminary plat application for 57 lots from Dainard Paulson, 700½ W. Goodlander Road Selah, WA 98942. The application was deemed complete for processing on January 5, 2016. The decision on this application will be made within one-hundred twenty days of the determination of complete application.

Project Description: Subdivide 18.6 acres into 57 lots in four phases. Proposed residential lot sizes range from 8,018 to 55,027 square feet and average 10,980 square feet. One lot is an existing separate parcel that will be incorporated into the subdivision. A boundary line adjustment will be necessary to merge part of the subject property into a separate parcel that is not part of this application. A temporary private access road is to be used to serve the first two phases until the remaining property is developed after which its use is to be discontinued and access provided by a public street. The project is to be served by municipal sewer and water.

Location: South side of W. Goodlander Road about 220 feet west of the intersection with Braeburn Court and about 700 feet southeast of the intersection with 13th Street in the City of Selah. (Yakima County Assessor Parcel Numbers: 181435-21013 & 21014).

Approvals, Actions and Required Studies: Preliminary Plat.

Environmental Review: The City of Selah is the lead agency for this proposal under the State Environmental Policy Act (SEPA). The City has reviewed the proposal for probable adverse environmental impacts and expects to issue a Determination of Nonsignificance (DNS). The optional DNS process in WAC 197-11-355 is being used. This may be your only opportunity to comment on the environmental impacts of the proposal. Since the current proposal is substantially unchanged from that reviewed previously, the City also expects to adopt a previously issued Determination of Nonsignificance. The proposal may include mitigation measures regardless of whether an EIS is prepared. After all comments have been received and considered, a threshold determination will be made without an additional comment period. Comments received by 5:00 PM, February 2, 2016 will be considered in making the determination. A copy will be sent to those who comment or may be obtained upon request. The determination will have specific appeal information and may be appealed within five business days of issuance.

Written comments are being accepted and will be considered in making a threshold environmental determination, which will be issued after the comment period ends.

Request for Written Comments on the Proposal Written comments concerning the proposed subdivision will be accepted during the public comment period that expires at 5:00.p.m, on February 2, 2016. Comments may be mailed to the Selah Planning Department, 222 So. Open Record Public Hearing An open record public hearing on the proposed subdivision will be held before the City of Selah Hearing Examiner. The Examiner will conduct the hearing on WEDNESDAY, FEBRUARY 17, 2016 COMMENCING AT 10:00 A.M. in the Council Chambers, City of Selah City Hall, 115 W. Naches Ave. Selah, WA. At the conclusion of the public hearing the Examiner will prepare a recommendation for preliminary plat approval, approval with conditions, or denial which will be transmitted to the Selah City Council for its consideration and final disposition.

Application information including the previously issued SEPA determination, the environmental checklist on which it is based, and maps detailing the proposal are available during regular business hours at the Planning Department at 222 South Rushmore Road, Selah, Washington 98942.
