Notice – Keep Objects Off Rights-of-Way
The City of Selah is legally required to keep public rights-of-way – such as sidewalks, curbs and streets – free from any obstructions or items.
What Does the Law Say?
Under RCW 46.61.570, it is unlawful to stop, stand, or park a vehicle (or obstruction) in a way that impedes traffic or blocks access to sidewalks or driveways. Additionally, RCW 35A.11.020 gives cities the authority to regulate use of public rights-of-way.
The Selah Municipal Code (SMC) regulates the placement of objects on public rights-of-way. SMC 11.02.010(6) incorporates the International Property Maintenance Code (IPMC). In turn, IMPC 302.3 requires that public rights-of-way must be kept free of hazardous conditions. SMC Chapter 8.71 also prohibits hazardous parking and/or any violation of RCW 46.51.570. Other provisions of law are also applicable.
Why It Matters
Objects such as portable basketball hoops, garbage bins left too long, trailers, “free” household item, etc.:
• Prohibit fire department equipment from accessing a hydrant or a physical area, or from being able to turn around.
• Block drivers’ views, increasing the risk of accidents.
• Obstruct the path of pedestrians, including children and people with disabilities.
• Interfere with snow removal and street maintenance.
• Pose serious liability risks for property owners.
What You Can Do
• Remove any objects that you have placed on public rights-of-way, or that exist on public rights-of-way adjacent to your property.
• Store your objects on your own property — not on the sidewalk, curb or street.
